After this point, neither party can withdraw without legal consequences.

By comparison, in England and Wales, offers are not legally binding until contracts are formally exchanged, meaning transactions can be more prone to delay or renegotiation.

Buyers of additional residential property pay Land and Buildings Transaction Tax (LBTT) plus an Additional Dwelling Supplement (ADS). LBTT is Scotland’s property transaction tax, applied on a progressive basis depending on the purchase price. In addition, an Additional Dwelling Supplement (ADS) applies when a buyer owns more than one residential property at the end of the transaction.

  • It applies to second homes, buy-to-let properties, and certain inherited or jointly owned properties
  • It is charged as a percentage of the total purchase price, not in bands
  • It usually applies where the buyer owns another residential property anywhere in the world
  • Relief or repayment may be available if a main residence is replaced, subject to qualifying conditions 

Tax rates and relief rules are set by the Scottish Government and may change over time, so current rates should always be confirmed before purchase.
