Our principal Partner for Lease Advisory in Scotland, Andrew Hill, has been active in the landlord and tenant sector for nearly 20 years and involved in a diverse range of commercial property and instructions across the length and breadth of the Country. The result of which is sound dependable knowledge and experience allied to a drive to continuously achieve positive result for our clients.

Knight Frank are one of the most active agents in Scotland and our Lease Advisory Team work in close alliance with our agency colleagues to ensure we keep abreast and are made aware of the most pertinent letting transactions and changes in market dynamics to utilise to our best advantage in negotiation.

We are strong negotiators in each of the principal lease advisory mediums, whether that be rent review, lease restructuring or lease renewal. Our mantra, first ascertain the client’s objectives and aims and use this as a driving principal with our negotiations.

At rent review, we have vast experience representing clients in the dispute resolution process with the preparation of submissions to Royal Institution of Chartered Surveyor (RICS) appointed Arbitrators and Independent Experts. Additionally, Andrew Hill sits on the aforementioned RICS dispute resolution Chairman’s Panel in Scotland to act as Independent Expert, where the parties are unable to reach a negotiated settlement.

Given the lack of security of tenure, unique to Scotland landlords ordinarily seek to capitalise and secure inflated rents at lease expiry, which in the instance of multiple property holdings allows them to cascade this new evidence onto future lease events across their estate.  This position is amplified when demand outstrips supply.

At lease renewal for tenant representation, we typically work in tandem with our agency and building surveying teams to provide a combined service line offer when assessing the merits of continuity of occupation or alternative re-location opportunities. Our advice is to initiate and plan strategy well in advance of the physical lease expiry to maximise options.

We have a strong track record in lease re-gears and securing significant gains for our clients. Lease re-gears are more typically appraised well in advance of lease expiry, where the landlord may benefit from an increased lease term, and resultant investment value gain and by so doing offer the tenant rent free or a lowered rent to tempt them into extending. It additionally provides the opportunity to amend any prejudicial or archaic lease clauses and provide a modern lease form.
